If your employer is “non-subscriber,” to the Texas workers’ compensation system, you may still have coverage for work injuries. Injured workers of non-subscribers have the legal right to file a lawsuit against their employer to recover all damages sustained as a result of their employer’s negligence under §406.033 of the Texas Labor Code.
Section 451 of the Texas Labor Code protects workers from being discriminated against by their employer for filing a workers’ compensation claim in good faith.
